В научной статье рассмотрена правовая и коммуникативная природа цифрового конституционализма в отечественных и зарубежных исследованиях. На основе анализа доктринальных источников, действующего законодательства и судебной практики освещены различные подходы к определению цифрового конституционализма, в том числе рассмотрен цифровой конституционализм как концепция, направленная на противостояние цифровым вызовам и изменениям конституционного равновесия. В работе обосновывается необходимость системного вовлечения граждан в государственные управленческие и стратегические процессы на местном и региональном уровнях с помощью цифровых технологий. Вместе с этим в рамках работы делается вывод о необходимости комплексного регулирования цифрового конституционализма, предлагается разработать Федеральный закон «О гарантиях реализации конституционных прав и свобод в цифровом и информационном пространстве», закрепив в нем цифровые права в публично-правовой сфере, цифровые этические принципы и особенности осуществления конституционных обязанностей граждан Российской Федерации в условиях цифровой среды. 

This research article examines the legal and communicative nature of digital constitutionalism in domestic and international research. Based on an analysis of doctrinal sources, current legislation, and judicial practice, it highlights various approaches to defining digital constitutionalism, including examining digital constitutionalism as a concept aimed at countering digital challenges and changes in the constitutional balance. The paper substantiates the need for systematic citizen engagement in public administration strategic processes at the local and regional levels using digital technologies. Furthermore, the paper concludes on the need for comprehensive regulation of digital constitutionalism and proposes the development of a Federal Law «On Guarantees for the Implementation of Constitutional Rights and Freedoms in the Digital and Information Space» that would enshrine digital rights in the public legal sphere, digital ethical principles, and the specifics of the exercise of constitutional duties by citizens of the Russian Federation in the digital environment.
