Function and Purpose of Patent Compulsory Licensing

Abstract
The article examines the institution of patent compulsory licensing, its historical origins, normative foundations, and functional purpose in the modern legal system. Based on an analysis of international patent law and art. 1362 of the Russian Civil Code, the study identifies, substantiates, and elaborates four central functions of the institution – the compensatory-regulatory, stimulating, socio-economic, and innovation-promoting functions. The article demonstrates their interrelation and practical limitations in the context of enforcement issues, including the discretionary nature of the “significant technical advance” criterion, the difficulties of proving abuse of patent monopoly, and the risks associated with the imprudent application of compulsory licensing on patents (illustrated by cases involving pharmaceuticals, including Trikafta and disputes concerning semaglutide).
